THESE TERMS OF USE (THESE "TERMS") SET FORTH THE LEGALLY BINDING TERMS AND CONDITIONS THAT GOVERN YOUR USE OF THE SITE. 1.1 Account Creation. You may delete your Account at any time, for any reason, by following the instructions on the Site. Company may suspend or terminate your Account in accordance with Section 6.
1.2 Account Responsibilities. You are responsible for maintaining the confidentiality of your Account login information and are fully responsible for all activities that occur under your Account. You agree to immediately notify Company of any unauthorized use, or suspected unauthorized use, of your Account or any other breach of security. Company cannot and will not be liable for any loss or damage arising from your failure to comply with the above requirements.
1.3 Mobile Message Service Terms and Conditions. The Cremerie mobile message service (the "Service") is operated by Cremerie Beauty LLC ("Cremerie," "we," or "us"). Your use of the Service constitutes your agreement to these terms and conditions ("Mobile Terms"). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time, and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes. By consenting to Cremerie's SMS/text messaging service, you agree to receive recurring SMS/text messages with service related and promotional messages, including updates, alerts, and information (e.g., order updates, account alerts, etc.) and promotions, specials, and other marketing offers (e.g., cart reminders) from and on behalf of Cremerie via text messages through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Cremerie. Your participation in this program is completely voluntary.
We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. You may opt out of the Service at any time by replying with the single keyword STOP. You will receive a one time opt out confirmation text message. No further messages will be sent to your mobile device unless initiated by you. For help, reply HELP or contact us at info@cremeriebeauty.com. If you have subscribed to other Cremerie mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms. We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honoring requests made in such messages.
The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service. Our products are cosmetics for external use only. Check the ingredients before use and stop using a product if irritation occurs.

You agree to indemnify Company against any third party claim arising from your violation of these Terms.
Company may suspend or terminate your access to the Site, including your Account, at any time if you violate these Terms.
7.1 Arbitration. Please contact us first at info@cremeriebeauty.com so we can try to resolve any issue informally. If it is not resolved within 30 days, any dispute will be settled by binding individual arbitration under the American Arbitration Association's Consumer Arbitration Rules, except that either party may bring a claim in small claims court. YOU AND COMPANY WAIVE ANY RIGHT TO A JURY TRIAL OR TO PARTICIPATE IN A CLASS ACTION.
7.2 Governing Law. These Terms are governed by the laws of the State of Florida. Any claim not subject to arbitration will be brought in the state or federal courts in Palm Beach County, Florida.
We may update these Terms by posting a new version on this page with a new revision date. Continued use of the Site means you accept the changes. If any part of these Terms is found unenforceable, the rest remains in effect.
